    What is an “umbrella policy” and how much does it cost?

    What is an Umbrella Policy?

    Most personal insurance policies provide liability coverage to protect you if you are sued as a result of an injury you are responsible for, whether it is bodily injury or personal injury. Lawsuits can stem from auto accidents, boating accidents, slip and falls, libel, slander, etc. but what happens when the liability on your auto, boat, or home insurance policy isn’t enough to satisfy a judgment against you? If you carry a Personal Umbrella policy, you potentially have coverage for the amount of the judgment above your normal limits that would otherwise come out of your own pocket.

    What is a Personal Umbrella policy, you ask? It’s an excess liability policy above and beyond your personal insurance policies. Like an “umbrella” to protect you from the proverbial rainy day, this policy is specifically designed to provide additional liability coverage for those instances where the coverage on your primary policies (auto, home, boat, dwelling fire, etc.) is simply not enough to satisfy a judgment against you.

    Here’s an example: Let’s say you are at fault in an auto accident and have Bodily Injury Coverage with a limit of $250,000 per person/$500,000 per accident. You are sued by the injured party and the judgement is $1,000,000. Your auto policy will cover $250,000 of the judgment. The remaining $750,000 will be paid through other means such as a lien on your home (if you own one), wage garnishment, etc., unless you have a Personal Umbrella policy. If you have a Personal Umbrella policy with a limit of $1,000,000, then this policy will kick in after your auto policy is exhausted and cover the remaining $750,000.

    Are You Qualified?

    There are certain requirements you must meet to purchase a Personal Umbrella policy. The biggest of these requirements is the minimum liability coverage you are required to carry on all of your underlying policies. Most carriers will require that you carry no less than $250,000 per person/$500,000 per accident on all auto policies. Home policies are typically required to have at least $300,000 in liability coverage. Boats and recreational vehicles are required to be insured and will also have to carry similar limits on the policies to those of the auto and home policies. Another requirement is good driving. Insurance carriers will look at the driving experience and driving record of those being covered on the policy, and can increase their rates or outright deny coverage based on these factors.

    Prices of Personal Umbrella policies will vary based on the amount of risks being covered. The more homes, autos, boats, and recreational vehicles you own, the higher the premium will be.

    Does Your Business Have Commercial Property Fire Coverage?

    You never think it’ll happen to you, until it does… Then what?

    A fire in your workplace can be extremely costly; in addition to the costs associated with fixing the damages, there is also a good chance that your day-to-day business activities will be interrupted during the repairs. To avoid potential expenses related to workplace fires, it is important that you have adequate fire coverage, which is included as part of most property insurance policies for commercial buildings. However, it is important that you understand your policy to make sure it provides all the protection you need and that you aren’t paying too much for premiums.

    Types of Coverage

    There are two primary factors that come into play when dealing with fire protection. Make sure your coverage incorporates them both to make sure you won’t be left holding the bill.

    Commercial Property: This is the portion of your policy covers the building itself and the equipment in it. When there is a loss to physical assets caused by a fire, this is what pays for replacement and repair costs.

    Commercial Casualty: In the aftermath of a fire, there may be a time period where you may not be able to conduct business, often due to a damaged workspace. This part of your policy will cover any loss of revenue during the recovery period of a fire.

    Coverages will offer different levels of protection based on your policy. Review your situation to ensure that the amount of coverage is comparable to your potential risks.

    Fire Sprinkler System Credit

    You can greatly reduce your premiums for fire coverage by installing a sprinkler alarm system. With some insurance providers offering 10 to 60 percent discounts, these systems can quickly pay for themselves. However, to get your full credit, you have to make sure that your system is reviewed regularly.

    According to the Insurance Services Office (ISO), many organizations receive partial to no credit on their fire insurance expenses for having a fire sprinkler system in place. This is because the facility and the sprinkler system have not been properly inspected in order to provide full credit. At the request of your insurance company, ISO can inspect your facility and develop an accurate credit on your fire insurance, which will reduce your overhead costs and increase your bottom line.

    Fire Sprinkler Evaluation Process

    The ISO fire sprinkler evaluation process consists of a review of the following areas:

    • The system design is based on the requirements of occupancy
    • Adequate water supply
    • System installation and components
    • System test
    • An inspection of building areas without sprinklers
    • Building conditions that could affect sprinkler operation

    Necessary Testing and Certifications

    The following must be reviewed or completed before you receive an ISO credit:

    • Main drain test
    • Copy of the Underground and Overhead Piping Hydraulic Test Certificate
    • Dry pipe trip test results (applicable to systems with dry pipe valves only)
    • Fire pump performance test results (systems with fire pumps only)
    • System design criteria evaluation through a review of the sprinkler plans, hydraulic calculations or hydraulic data plaque information

    Fenzl has over 40 years of experience in the insurance industry working for various independent agencies in WNY.     According to the U.S. Department of Health and Human Services, the official government goal for the year 2020 is to be up to a 70 percent five-year survivor-ship rate.

    Life after cancer is a growing reality for a number of Americans who are now described as cancer survivors, rather than victims. However, there is significant emotional, physical and financial stress associated with fighting cancer, and survivors may have trouble coping with the aftermath of a cancer battle.

    Cancer Survivors Are On the Rise
    People are now surviving long after they have been diagnosed with cancer. Advances in early detection, better and more targeted drugs, and improved technologies are making remission a reality for millions. In addition, statistics show that those diagnosed with cancer have reasons now, more than ever before, to be hopeful.

    Seek Out Support
    Though you are undoubtedly grateful to have survived your battle with cancer, there is no shame in struggling to adjust to your life after cancer. You may have physical limitations, financial hardships or emotional stress. It is important to take care of your needs and seek out support when it is too much to handle on your own:

    • Ask your doctor for a referral to a therapist, counselor or support group. A therapist can not only help you emotionally, but can also help you find financial resources for cancer patients and survivors
    • Share your concerns with family and close friends, and let them know that you need their support. This may include helping you overcome a physical limitation in your daily life, or simply having someone to talk to
    • Utilize online resources such as http://csn.cancer.org, which offers online support groups and other valuable information for cancer survivors
    • Seek out local resources, such as community organizations, church groups or social services

    Live a Healthy Life!
    If you beat your battle with cancer, ensure you live the healthiest life possible going forward. Get plenty of exercise on a daily basis; 30 minutes or more are encouraged. Eat whole grains, plenty of vegetables and fruits, lean sources of protein and drink lots of water. Stay away from excessive amounts of salt, fat, alcohol and sweets. Finally, follow up with your physician on a regular basis.

    How to Stay Hydrated in the Heat!

    Dehydration may seem like a minor ailment, but it can be quite dangerous. In fact, millions of people worldwide (many of them infants and older adults) die of dehydration each year. In hot or humid weather, it is essential to drink additional water to help lower your body’s temperature and to replace what you lose through sweating.

    Get the facts
    In the simplest terms, dehydration occurs when you lose more water than you take in and your body does not have enough water to carry out its normal functions. What’s more, even mild dehydration-as little as a 1 to 2 percent loss of body weight-can cause symptoms such as weakness, dizziness and fatigue, and may have a negative effect on long-term health.

    Water Loss
    On average, adults lose about 2.5 liters (more than 10 cups) of water a day, simply by doing everyday tasks such as sweating, breathing and going to the bathroom. Also lost are electrolytes—minerals such as sodium, potassium and calcium—that maintain the balance of fluids in your body. This is before you may even think about mowing the lawn on a humid afternoon, working out at the gym or rearranging the living room furniture—all of which cause much higher water loss.

    Symptoms
    Mild to moderate dehydration is likely to cause the following symptoms:

    • Excessive thirst
    • Sleepiness
    • Dry mouth
    • Few or no tears when crying
    • Muscle weakness
    • Headache
    • Dizziness or lightheadedness

    Prevent Dehydration
    Preventing dehydration sounds easy enough: consume plenty of fluids and foods high in water content, like fruits and vegetables. However, how much fluid do we really need? Determining your appropriate water intake is not an exact science, as much depends on age, physical condition, activity level, environment and individual physiology.

    The best recommendation is to simply make a conscious effort to stay hydrated. In addition, make water your beverage of choice! Try drinking water with every meal and between meals. Take water breaks instead of coffee or tea breaks, and substitute sparkling water for alcohol.

    How Important are Preventative Screenings for Men?

    Proper preventive screenings can help keep you healthy.

    Colorectal Cancer Screening
    Colorectal cancer screening tests detect cancerous cells and growths, or polyps, that may become cancerous on the inside wall of the colon. Not everyone needs to be tested for colon cancer, though, the need depends on individual risk level. Three major factors influence the risk for colon cancer:

    • Age 50 or older
    • A family or personal history of colorectal cancer or precancerous polyps
    • A personal history of inflammatory bowel disease

    If you have these higher risk factors for developing colon cancer, the American Cancer Society (ACS) suggests talking with your doctor about screenings.

    Prostate Cancer Screening
    Prostate cancer is the most common cancer (besides skin cancer) in American men. As men age, their risk of prostate cancer increases. The ACS suggests that men age 50 and older speak to their doctor about prostate screenings. Consider initiating this talk at an earlier age if you are African-American or have a family history of prostate cancer.

    Testicular Exam
    Testicular cancer is the most common type of tumor in American men between the ages of 15 and 35. For this reason, all men should receive a testicular examination every time they have a physical exam. In addition, men of all ages, beginning in their teens, should perform a monthly self-examination of their testicles. Testicular exams should check for any masses, as well as changes in size, shape or consistency.     Dental Exam
    The American Dental Association recommends regular dental checkups in which the dentist examines the teeth and gums. In addition, the dentist can evaluate bite and determine problems such as teeth grinding or issues with the jaw joint.

    Eye Exam
    Eye examinations can determine a need for glasses or contact lenses or a need for a changed prescription. They can also identify new vision problems. Common vision problems detected by regular eye exams include glaucoma, macular degeneration and cataracts.

    Hearing Test
    A hearing test determines potential hearing loss. The American Speech Language Hearing Association recommends screening at least every 10 years through age 50, and every three years thereafter. Ask your doctor how often you should have your hearing checked.

    Skin Check
    To check for skin cancer, the doctor will examine your skin from head to toe, looking for moles that are irregularly shaped, have varied colors, are asymmetric, are greater than the size of a pencil eraser, or have grown or changed since your last visit. Talk to your doctor about getting a skin exam during your regular checkup, and also perform routine self-exams, looking for any spots or moles that fit the above characteristics.

    Going on Vacation this Summer? Prepare Your Home before Departure

    Graduation ceremonies have come and gone, schools are out, and it’s time for that vacation you’ve been anxiously awaiting for months. We all look forward to arriving at our destination, but what can you do before you leave to prepare your home for while you’re away?

    Stop your mail: The United States Postal Service has a handy app for smartphones, and also offers a Hold Mail option on their website under the “Manage Your Mail” link. Enter your address to check for availability online before making your request or visit your post office to fill out a Hold Mail request in person.

    Stop your newspaper: If you still receive a good old-fashioned newspaper at home, make sure to ask your carrier to stop delivery or ask a neighbor to pick it up for you while you are away. Some houses also receive free newspapers weekly on our driveway so don’t forget about those too!

    Place lights on timers: Keep a light or two in your home on a timer while you are away. Lights in the home give the appearance of an occupied home. A dark home can be a welcome sign for thieves.

    Consider shutting off water sources: Pipes can leak (or burst) while you’re away, leaving a mess when you get home. The easiest place to start is the water to the washer and dryer.

    Tell a neighbor, the local authorities, and/or your alarm company you’ll be away: Even if you don’t expect mail or newspapers to arrive, let a neighbor know that you’re away. They can keep an eye out and let you know if anything significant occurs while you’re away. In some communities, the local authorities can be alerted to your absence and will drive by your property periodically.

    Set your thermostat: Raise the temperature on your thermostat so that you are not paying to cool your home while you are away. During the winter, turn down (but do not turn off) the heat so you are not heating your home as much as you need to while you’re home.

    Arrange to have your grass mowed or snow removed when on longer trips: This last one is self-explanatory!

    Other things to consider such as:

    • Have a friend water your plants
    • Obtain a pet sitter or find a boarding facility for your pet
    • Make sure your bills are paid ahead of your vacation or contact your credit card companies to inform them of your plans if you are travelling to a far-off destination

    ICE Planning Surge of I-9 Audits in Summer 2018 — What Benefits Admins Need to Know!

    Immigration and Customs Enforcement (ICE) is planning a nationwide increase of Form I-9 audits this summer.

    Derek Benner, acting executive associate director for ICE’s Homeland Security Investigations (HSI) told The Associated Press that in addition to the plans for this summer, the agency will continue to focus on criminal cases against employers and deporting employees who are in the country illegally.

    ICE has already opened more worksite investigations seven months into fiscal year (FY) 2018 than the agency completed in all of FY 2017. The federal fiscal year runs from Oct. 1 to Sept. 30. Enforcement investigations in FY 2018 have doubled last year’s total, and arrests related to worksite enforcement have nearly quadrupled.

    Since October 2017, HSI has opened 3,510 worksite investigations, initiated 2,282 I-9 audits, and made 594 criminal and 610 administrative worksite-related arrests. That’s up from 1,716 investigations, 1,360 I-9 audits, 139 criminal arrests and 172 administrative arrests the previous fiscal year.

    These numbers indicate a significant increase in enforcement action, noted Muzaffar Chishti, an attorney and director of the Migration Policy Institute’s office at New York University School of Law. “What is not clear is whether any employers are included in the arrests,” he said. “Arrests—both criminal and civil—are almost always workers. For example, no one from management was charged in the high-profile Tennessee raid in April. That seems to be an imbalance.”

    The ICE Toolkit

    • Compliance, via Form I-9 audits, civil fines and debarment from federal contracts
    • Enforcement, through the criminal arrests of employers and administrative arrests of unauthorized workers
    • Outreach, by participating in the ICE Mutual Agreement between Government and Employers program, in which ICE certifies organizations for complying with the law. As part of the program, ICE and U.S. Citizenship and Immigration Services provide education and training on proper hiring procedures, fraudulent document detection and use of the E-Verify employment eligibility verification system

    Chishti believes pushing employers to enroll in E-Verify may be the aim of ICE’s more aggressive enforcement actions. “That strategy may work, but it only works for people who are on payroll,” he said.

    E-Verify doesn’t enforce compliance for people paid as independent contractors, outsourced workers or those paid off the books, he said, adding that there’s a tendency for employers to explore these alternative hiring methods in response to increased enforcement.

    Be Prepared for a New Normal

    Soon, ICE intends to conduct up to 15,000 Form I-9 audits per year, to be completed by electronically scanning documents in a not-yet-created national inspection center, Benner said.

    “Investigations most often start with a notice of inspection alerting employers that ICE is going to audit their employment records for compliance with existing law,” said Michael H. Neifach, an attorney in the Washington, D.C., region office of Jackson Lewis. Enforcement actions can begin from a law enforcement tip or from an investigation into another type of violation, such as labor standards violations, and could result in civil penalties and/or criminal charges for employers.

    ICE recently changed the way it calculates civil penalties to increase the fines imposed for I-9 violations. In FY 2017, employers were ordered to pay $97.6 million in judicial forfeitures, fines and restitution, and $7.8 million in civil fines.

    “Unauthorized employees who are not legally in the U.S. may be detained and, ultimately, deported,” Neifach said. “Given the government’s focus on worksite inspections, preparing for possible inspections by auditing your employment verification processes and records is an essential precaution.”
