For eligible Workers’ Compensation policies effective on or after 10/1/25, the New York Compensation Rating Board (NYCIRB) has made some changes to The New York Construction Classification Premium Adjustment Program (CPAP). Note there are no changes to the class code or wage eligibility of the program.

Listed below is a summary of the main points and changes:

  • In order to increase participation, employers will no longer submit a CPAP application in advance of their upcoming Workers’ Compensation policy renewal date. Now all insurance companies will ask for policyholders to provide CPAP payroll information during the year-end premium audit.
  • Within 10 business days of the auditor’s request, employers will still need to provide the assigned class code, number of hours worked during the policy period, payroll/remuneration during the policy period or average base hourly wage per employee. See the sample table and list of eligible construction class codes in the attachment. Your insurance company will either provide a prescribed payroll spreadsheet or ask you to complete a CPAP estimator on the NYCIRB website.
  • Upon receipt of this required information, the current insurer will transmit it to NYCIRB for credit determination. NYCIRB will calculate the credit percentage and send it to the insurer so that it can be applied to the final premium. Credits will be based on annual payroll data, not a single quarter.
  • There will be a reward for higher wage paying employers. The program will apply a wage credit using a table that appropriately benchmarks high wages in each eligible classification code by weighting prevailing wage information published by the New York State Department of Labor.
  • Large risk retrospective rated policies, independently filed large deductible programs, and standard policies under $5,000 in annual premium are NOT eligible.
